U.S. Court of Appeals Case No: 10-2245
U.S. District Court for the District of North Dakota - Bismarck
[PUBLISHED] [Shepherd, Author, with Loken and Melloy, Circuit Judges]
Criminal case - Criminal law and Sentencing. Evidence was sufficient to
support only one of the five counts of aggravated sexual abuse, and while
the conviction on Count 5 is affirmed, the convictions on Counts 1
through 4 are reversed; evidentiary challenges rejected; district court did
not abuse its discretion by declining to conduct an evidentiary hearing into
possible juror misconduct as it was not clear that the juror had actually
answered any voir dire questions untruthfully; final sentence did not
violate defendant's double jeopardy rights as defendant had notice that the
sentence would include conditions of supervised release.
