Civil Case - civil rights. District court's grant of summary judgment on excessive force claim is reversed, as there are genuine issues of material fact. Individual claims against Carroll were properly dismissed. The Minnesota Government Data Practices Act claim is remanded for a ruling whether Johnson is entitled to costs or disbursements. The district court properly dismissed the state law battery claims as untimely. The grant of summary judgment on the basis official immunity claims is also reversed. Judge Gruender concurs in part and dissents in part.
