U.S. Court of Appeals Case No: 10-2903
U.S. District Court for the Western District of Arkansas - Ft. Smith
[PUBLISHED] [Melloy, Author, with Wollman and Gilman, Circuit Judges]
Civil case - insurance. For the court's prior opinion in the matter see
Triple H Debris Removal, Inc. V. Companion Prop. & Cas. Ins. Co., 560
F.3d 881 (8th Cir. 2009). District court did not err in denying motion to
take judicial notice of counsel's statements at the oral argument in the
first appeal and in pretrial filings; jury instructions on agent, agency and
breach of contract were not erroneous; district court did not err in refusing
jury instructions regarding ambiguous contract provisions; evidence was
sufficient to support the jury's verdict on the issues of cancellation of the
policy and bona fide dispute.
