U.S. Court of Appeals Case No: 10-3387
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Melloy, Author, with Beam and Gruender, Circuit Judges]
Criminal case - Criminal law and sentencing. The district court did not
err in concluding defendant consented to the search that led to the seizure
of ammunition which led to his prosecution; claim of prosecutorial
misconduct relating to a question about state charges is rejected as the
court could not say that the incident prejudiced defendant; evidence was
sufficient to support defendant's conviction for being a felon in possession
of ammunition; no error in imposing an enhancement for perjury; sentence
was not substantively unreasonable.
