U.S. Court of Appeals Case No: 10-3398
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Benton, Author, with Melloy and Smith, Circuit Judges]
Civil case - Family and Medical Leave Act. Because defendant failed to
offer a non-discriminatory reason for its alleged act of terminating plaintiff
in retaliation for exercising her FMLA rights, the proper inquiry for the
district court was whether plaintiff's evidence was sufficient to establish a
prima facie case; however, plaintiff failed to establish a causal link
between the protected conduct and the adverse action, and she failed to
make a prima facie case.
