Civil case - Torts. In action alleging defendants invaded plaintiff's
privacy and breached their fiduciary duty of confidentiality by giving nude
photographic images of her to a newspaper, which published the images,
the district court abused its discretion by excluding testimony from the
newspaper's staff writer regarding her receipt and use of the photos;
however, on remand, retrial will be limited to the issue of punitive
damages as the evidence was unlikely to have affected the jury's verdict
on plaintiff's invasion of privacy claim or the issue of compensatory
