U.S. Court of Appeals Case No: 10-3454
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Riley, Author, with Benton and Shepherd, Circuit Judges]
Criminal case - Criminal law. Police had reasonable suspicion that
defendant and his vehicle were connected to bank robbery and that
suspicion justified an investigatory detention; reasonable safety
precautions the officers exercised in approaching the vehicle did not
convert the stop to an arrest; defendant's conduct after the stop, including
refusal to cooperate and flight, provided probable cause for his arrest;
defendant abandoned his vehicle when he left his car open, with the motor
running in a public area and fled the police.
