U.S. Court of Appeals Case No: 10-6045
U.S. Bankruptcy Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Nail, Author, with Kressel, Chief Judge, and Saladino,
Bankruptcy Judge]
Bankruptcy Appellate Panel. Bankruptcy Court did not err in finding
that the bank's claim against debtor was dischargeable under 11 U.S.C.
Sec. 523(a)(2)(B); the court did not clearly err in finding that debtor and
his wife's financial statements did not paint a substantially untruthful
picture of their financial situation and that the statement were not
materially false; nor did the court err in finding that the bank did not rely
on the statements; court's finding that the debtor lacked requisite intent to
deceive the bank was not clearly erroneous.
