U.S. Court of Appeals Case No: 11-1046
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Benton, Author, with Riley, Chief Judge, and Loken,
Circuit Judge]
Civil case - employment discrimination. Plaintiff failed to establish a
prima facie case of Title VII discrimination based on national origin as she
did not show that the circumstances of her termination gave rise to an
inference of discrimination; assuming plaintiff had made a prima facie
case, she failed to show defendant's legitimate, non-discriminatory ground
for her discharge - her work performance - was a pretext for unlawful
discrimination; district court did not err in dismissing plaintiff's claim that
she was retaliated against for reporting discrimination.
