U.S. Court of Appeals Case No: 11-1091
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Wollman, Author, with Murphy and Benton, Circuit Judges]
Civil case - Investment Company Act of 1940. For the court's prior
opinion in the matter, see Gallus v. Ameriprise Financial, Inc., 561 F.3d
816 (8th Cir. 2009). District court did not err in granting defendants'
motion for summary judgment as plaintiffs failed to set forth sufficient
evidence on their claim that defendants, mutual fund advisors, breached
their fiduciary duty with respect to the receipt of compensation for
services imposed by Section 36(b) of the Investment Company Act of
1940.
