U.S. Court of Appeals Case No: 11-1156
and No: 11-1287
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Gruender, Author, with Melloy and Beam, Circuit Judges]
Criminal case - Criminal law and sentencing. Evidence was sufficient to
support defendant's conviction for being a felon in possession of a
firearm; the district court erred in failing to sentence defendant as an
armed career criminal under the Armed Career Criminal Act as his
Minnesota Third and Fourth Degree drug convictions were serious drug
offenses under 18 U.S.C. Sec. 924(e)(2)(A)(ii).
