Civil Case - employment discrimination. Husband and wife each claimed
age and race discrimination and retaliation for filing grievance. District
court's grant of summary judgment is affirmed on all claims. Even if the
collective evidence established a prima facie case of race and age
discrimination, the evidence was insufficient to prove the employer's
actions were a pretext for discrimination. The district court properly
determined Lena did make out a prima facie case of retaliation and
James's retaliation claim was properly denied because he did no show his
termination was pretextual.
