U.S. Court of Appeals Case No: 11-1473
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Loken, Author, with Chief Judge Riley and Benton,
Circuit Judges]
Civil Case - employment. Grant of summary judgment to employer is
affirmed. Employer is entitled to qualified privilege as a matter of law on
the defamation claim. Breach of contract claim failed because payment
of bonus was discretionary. Summary judgment on age discrimination
claim was appropriate because Chambers failed to show her replacements
were sufficiently younger and failed to show the reason for her discharge
was pretextual. District court correctly concluded Chambers failed to
establish an plan interference claim under ERISA. District court did not
abuse its discretion in denying continuance.
