U.S. Court of Appeals Case No: 11-1546
U.S. District Court for the District of South Dakota - Pierre
[PUBLISHED] [Shepherd, Author, with Loken and Bright, Circuit
   Judges]
Criminal Case - conviction. The district court's did not violate defendant's rights under the Confrontation Clause by limiting cross- examination of prior false allegations by victims because evidence was too attenuated to provide more than minimal probative value. District court did not err in disallowing testimony under Rule 403. District court did not erred in releasing witness, who had since recanted, from government subpoena. Motions to supplement the record are denied. Judge Bright dissents.
