Civil case - Consumer law. The provisions of 15 U.S.C. Sec. 1692a(3)
include individuals who are mistakenly dunned by debt collectors, and the
district court erred in finding that the plain language of the section's
definition of "consumer" did not apply to plaintiff because the debt
collector mistakenly alleged he owed a debt; however, the defendant
sufficiently verified the debt under the provisions of Sec. 1692g(b), and
the district court's order granting the defendant summary judgment is
affirmed.
