U.S. Court of Appeals Case No: 11-1560
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Wollman, Author, with Riley, Chief Judge, and Smith,
Circuit Judge]
Civil case - Consumer Law. State court judgment of dismissal was
preclusive under Minnesota law and the district court properly found
plaintiffs' non-Real Estate Settlement Practices Act claims were barred
by the doctrine of res judicata; as plaintiffs did not establish how their
complaint could be amended, the district court did not err in denying the
motion to amend their RESPA claim on the basis of futility.
