U.S. Court of Appeals Case No: 11-1723
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Riley, Author, with Shepherd, Circuit Judge, and
Webber, District Judge]
Criminal case - criminal law. In a prosecution for sex trafficking of a
minor under 18 U.S.C. Sec. 1951, the district court committed reversible
error when it instructed the jury that it could convict defendant if he knew
or acted in reckless disregard of the fact that the girl involved was
younger than 18 as the version of the statute in effect at the time of
defendant's 2007 offense required the government to prove defendant
actually knew that the girl was younger than 18.
