U.S. Court of Appeals Case No: 11-1830
U.S. District Court for the District of South Dakota - Sioux Falls
[PUBLISHED] [Smith, Author, with Bye and Colloton, Circuit Judges]
Criminal case - criminal law. An officer cognizant of defendant's
alleged child molestation of a victim and contemporaneous viewing of
child pornography with the victim could have reasonably presumed that
the warrant in question, which allowed officers to search for child
pornography on defendant's computer, was valid, and the district court
did not err in upholding the search under the Leon good-faith exception.
Judge Colloton, concurring in the judgment.
