U.S. Court of Appeals Case No: 11-1890
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Gruender, Author, with Smith and Colloton, Circuit Judges]
Criminal case - Criminal law. Where defendant did not offer any
evidence indicating the trash seized by police was not at the curb at the
time of the seizure, the district court did not err in denying his request
for an evidentiary hearing; it is well settled that there is no reasonable
expectation of privacy in trash left at the curb in an area accessible to the
public for pickup by the trash collectors.
