Civil case - Equal Access to Justice Act. In action alleging defendants
had engaged in a pattern or practice of sex discrimination in the rental of
housing in violation of the Fair Housing Act, while a jury found for
defendants, the district court erred in granting defendants' request for an
award of attorneys' fees under the Equal Access to Justice Act because
the court improperly considered the case as consisting of ten individual
victims' claims for separate assessment, rather than as a single pattern or
practice claim; when viewed correctly, the government's position as a
whole was substantially justified.
