Criminal case - Sentencing. Government did not breach the plea
agreement in its sentencing recommendation as it made the
recommendation it was obligated to make; even if the government's
comments at sentencing were a breach of the agreement, the breach did
not affect defendant's substantial rights and did not require a finding of
plain error since it was clear from the district court's sentencing statement
that it would not have imposed a more favorable sentence in the absence
of the government's comments.
