Civil case - Defamation. In action alleging defamation and false light
invasion of privacy, the district court erred in finding the statements in
question were substantially true; plaintiff was a private figure, not a
limited purpose public figure, and needed to only show negligence to
recover for defamation; plaintiff provided sufficient evidence that
defendant's statements, which arguably portrayed her as a racist, caused
her reputational harm; as plaintiff established all of the elements of the tort
of defamation under Missouri law, the district court erred in granting the
defendant summary judgment on her claim for defamation; Missouri
would not recognize plaintiff's false light of invasion of privacy claim, and
the district court did not err in dismissing the claim.
