U.S. Court of Appeals Case No: 11-2049
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Chief Judge Riley, Author, with Beam and Bye, Circuit Judges]
Criminal Case - conviction and sentence. Substantial evidence was
presented for a rational jury to find defendant guilty to assault beyond a
reasonable doubt. District court's finding White committed perjury
supports obstruction of justice enhancement. District court did not
clearly err in finding White was not entitled to minor participant
reduction or abuse its discretion in failing to take into account any
extraordinary rehabilitation. Inclusion of dangerous enhancement did not
render sentence substantively unreasonable.
