Civil case - civil rights. A reasonable police officer would not have deployed a taser under the circumstances presented in the case (an unarmed suspected misdemeanant, who did not resist arrest, did not run and did not act aggressively towards the officer); defendant officer's use of a taser under these circumstances amounted to a clearly established constitutional violation, and the district court did not err in denying the officer's motion for summary judgment based on qualified immunity.
