U.S. Court of Appeals Case No: 11-2127
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Melloy, Author, with Arnold and Shepherd, Circuit Judges]
Criminal case - Criminal law and sentencing. The district court did not
abuse its discretion in denying defendant's fourth request for a
continuance which was made on the morning of the trial; evidence was
sufficient to support defendant's conviction for being a felon in possession
of a firearm; district court did not err in sentencing defendant under the
Armed Career Criminal Act as his two prior burglary convictions were
independent predicate offenses for purposes of sentencing under the Act.
