U.S. Court of Appeals Case No: 11-2154
U.S. District Court for the Northern District of Iowa, Waterloo
[PUBLISHED] [Loken, Author, with Bright and Shepherd, Circuit Judges]
Criminal case - Sentencing. Court would not conduct a rational basis
review of Guidelines Sec. 2G2.2's base offense level and enhancements as
defendant's sentence was attributable not to the provisions of the
guideline but to the district court's unwillingness to exercise its
discretion to vary from those advisory provisions; defendant's appeal waiver
precluded challenging the substantive reasonableness of his sentence.
