U.S. Court of Appeals Case No: 11-2160
U.S. District Court for the District of Nebraska - Lincoln
[PUBLISHED] [Wollman, Author, with Loken and Gruender, Circuit Judges]
Civil case - Employment discrimination. Assuming without deciding
that plaintiff established a prima facie case of disability discrimination,
the employer provided a legitimate, non-discriminatory basis for plaintiff's
termination - violation of the company's rules against fighting - and
plaintiff failed to show the stated ground was a pretext; with respect to
plaintiff's hostile work environment claim, the claim failed because the
conduct complained of did not affect plaintiff's terms, conditions or
privileges of employment, did not rise the level of extreme behavior that is
objectively offensive and was not brought to management's attention.
