U.S. Court of Appeals Case No: 11-2218
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Gruender, Author, with Benton and Shepherd, Circuit Judges]
Civil case - consumer law. Provisions of Minnesota Stat. Sec. 580.07,
subdiv. 1 did not apply; Minnesota Credit Agreement Statute prohibits the
enforcement of an oral promise to postpone a foreclosure sale and the
district court correctly determined that the lender was entitled to summary
judgment on plaintiff's promissory estoppel claim; district court did not
err in granting summary judgment to the lender on plaintiff's negligent and
intentional misrepresentation claims as plaintiff filed to raise a genuine
question of material fact as to whether she detrimentally relied on the
lender's oral promise to postpone the foreclosure sale.
