U.S. Court of Appeals Case No: 11-2220
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Shepherd, Author, with Gruender and Benton, Circuit Judges]
Criminal case - Sentencing. The alleged procedural error - failure to follow Guideline Section 4A1.3's instruction regarding moving incrementally down the sentencing table - was harmless in light of the fact that the district court clearly stated that the sentence was also based on an upward departure under the section 3553(a) factors; sentence was substantively reasonable.
