U.S. Court of Appeals Case No: 11-2253
Board of Immigration Appeals
[PUBLISHED] [Shepherd, Author, with Chief Judge Riley and Melloy,
Circuit Judges]
Petition for Review - immigration. Immigration Judge and BIA did not
err in requiring Omondi to corroborate his claims of past persecution, as
it was reasonable under the circumstances to require corroboration even
where applicant's testimony is deemed credible. Board, however, did
not address argument that hearing transcript was deficient and it is not
apparent that Board ever considered the explanation as to why he was
unable to provide corroboration. Thus remand is appropriate for Board to
address issue.
