U.S. Court of Appeals Case No: 11-2506
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Colloton, Author, with Bye and Smith, Circuit Judges]
Criminal case - criminal law. Officers had sufficient grounds to detain
defendant based on a security guard's report that defendant had displayed
a weapon after his ejection from a nightclub; it was reasonably necessary
for officers to secure defendant to foreclose the possibility that he would
gain control of the gun and threaten their safety, and they did not exceed
the permissible bounds of an investigative stop when they handcuffed him
and placed in a patrol car.
