U.S. Court of Appeals Case No: 11-2564
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Smith, Author, with Riley, Chief Judge, and Wollman,
Circuit Judge]
Civil case - Commodity Exchange Act. Plaintiff did not plead a
fraudulent-inducement claim under 7 U.S.C. Sec. 6, but only alleged
defendant engaged in a fraudulent scheme under 7 U.S.C. Sec. 6o(1)(B);
district court did not err in granting defendant summary judgment on the
fraudulent scheme claim as plaintiff failed to show the Commodity
Exchange Act violation proximately caused its damage; district court did
not err in granting defendant summary judgment on plaintiff's breach-of-
fiduciary duty claim as plaintiff failed to state that defendant breached its
standard of care.
