U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Colloton, Author, with Arnold and Smith, Circuit Judges]
Civil case - Employment discrimination. Plaintiff failed to show that he was qualified to perform the essential functions of his position, without or without accommodation, and the district court did not err in granting the employer summary judgment on plaintiff's ADA claim; plaintiff's ADEA claim failed as he could not perform the duties of the position in question; plaintiff was an at-will employee and the City's termination of his employment did not deprive him of a property interest protected by the due process clause of the Fourteenth Amendment.
