Criminal case - Sentencing. District court did not err in imposing an
enhancement under Guidelines Sec. 4B1.4(b)(3)(A) for possession of a
firearm in connection with the charged drug offense; district court did not
err in refusing to give a third point under Guidelines Sec. 3E1.1(b) for
acceptance of responsibility as the timing of defendant's guilty plea - two
weeks before trial - did not permit the government and the court to
allocate resources efficiently; district court imposed a variance, not a
departure, and the notice provisions of Fed. R. Crim. P. 32(h) were
inapplicable; remanded for clarification as to whether the trial court
intended to impose a 262 month sentence (the top of the advisory
guidelines range) or an above-guidelines sentence of 264 months.
