U.S. Court of Appeals Case No: 11-3286
U.S. District Court for the District of Nebraska - Lincoln
[PUBLISHED] [Murphy, Author, with Benton and Shepherd, Circuit Judges]
Criminal case - Criminal law. Search warrant was supported by probable
cause and the information supplied in support of the warrant application
was not stale when taken as a whole; a witness's brief comment that he
had prior drug dealings with defendant did not prejudice defendant in light
of the district court's immediate giving of a limiting instruction and the
overwhelming evidence of defendant's involvement in the conspiracy;
evidence was sufficient to support defendant's conspiracy conviction.
