U.S. Court of Appeals Case No: 11-3487
and No: 11-3489
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Chief Judge Riley, Author, with Murphy and Melloy,
Circuit Judges]
Criminal Cases - sentence. In challenge to drug quantity attributable to
both defendants, district court did not clearly err in finding defendants
were part of a single conspiracy and in estimating the quantity of
methamphetamine attributable to each of them, and did not clearly err in
attributing "ice" methamphetamine to them even though there was no
evidence as to its purity, as there was sufficient circumstantial and
coconspirator's testimonial evidence. District court did not clearly err in
applying obstruction of justice enhancement to Hyde or in denying him
an acceptance of responsibility reduction.
