U.S. Court of Appeals Case No: 11-3729
U.S. District Court for the District of South Dakota - Pierre
[PUBLISHED] [Colloton, Author, with Riley, Chief Judge, and Gruender,
Circuit Judge]
Criminal case - Sentencing. Any error in imposing an enhancement
under Guidelines Sec. 2A2.2(b)(2)(B) was harmless as the district court
clearly indicated it would impose the same sentence with or without the
enhancement; court articulated specific reasons that were sufficient to
justify its sentencing decision.
