Civil Case - diversity - legal malpractice. District court's grant of summary judgment in favor of attorneys who failed to file a timely notice of appeal, is affirmed. There was sufficient evidence to support underlying jury verdict, so state appellate court would not have reversed the judgment on insufficient evidence grounds; the trial court did not abuse its discretion in admitting evidence of discovery disputes or in instructing the jury on spoliation of evidence; the trial court did not abuse its discretion in admitting hearsay statements or in admission of expert testimony, or in admitting a demonstrative animation.
