U.S. Court of Appeals Case No: 12-1073
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Arnold, Author, with Riley, Chief Judge, and
   Gruender, Circuit Judge]
Criminal case - Criminal law and sentencing. Violation of Minnesota Statute Sec. 609.487, subd. 3, for fleeing the police in a motor vehicle presented a serious potential risk of physical injury and was a violent felony under the Armed Career Criminal Act; district court did not err in concluding the government did not breach the plea agreement by arguing that defendant should be sentenced as an armed career criminal.
