Civil case - Class Actions. District court erred in certifying a class in an action alleging defendant violated a Minnesota Stat. Sec. 177.23; the varied context of the pizza delivery transactions made it unreasonable in some cases for customers to believe that the delivery charge was a payment for personal services and, as a result, the certified class of pizza delivery drivers does not meet the requirement of commonality and should not have been certified as a class.
