U.S. Court of Appeals Case No: 12-1427
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Chief Judge Riley, Author, with Smith and Colloton,
   Circuit Judges]
Criminal Case - conviction and sentence. First Amendment as applied challenge to 18 U.S.C. sec. 2261A(2)(A) fails because harassing and distressing communications fell outside protection of First Amendment, as the speech was integral to criminal conduct. Facial challenge fails. District court waived right to appeal denial of mistrial when he refused stipulation for a curative instruction, and any error was harmless. District court did not err in instructing jury that a "sexual relationship" was a "thing of value" under section 875(d). District court did not clearly err in applying obstruction of justice enhancement based on defendant's perjury. Convictions were supported by sufficient evidence.
