U.S. Court of Appeals Case No: 12-2195
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Melloy, Author, with Colloton and Shepherd, Circuit Judges]
Prisoner case - Habeas. Iowa Code Sec. 709C.1 was not unconstitutionally
vague as to Musser as he knew he was HIV positive and engaged in the type
of "intimate contact" the statute was plainly intended to prohibit; court
would not consider void-for-vagueness challenges based on the hypothetical
situations raised in the habeas petition and brief; Musser did not raise
any First Amendment concerns and he was precluded from asserting an
overbreadth challenge to the statute.
