Criminal Case - sentencing. On remand from the Supreme Court of the United States to consider this case in light of Descamps v. United States, 133 S. Ct. 2276 (2013), the conviction and sentence are affirmed, as the basic elements of the Missouri second-degree burglary statute are the same as those of the generic burglary offense; thus, the prior conviction qualifies as a crime of violence under the categorical approach.
