Criminal Case - sentencing. On remand from the Supreme Court of
the United States to consider this case in light of Descamps v. United
States, 133 S. Ct. 2276 (2013), the conviction and sentence are affirmed,
as the basic elements of the Missouri second-degree burglary statute are
the same as those of the generic burglary offense; thus, the prior
conviction qualifies as a crime of violence under the categorical
approach. Those other portions of the vacated opinion holding that the
district court did not abuse its discretion in limiting Olsson's ability
to cross examine government witnesses are reinstated.
