Civil case - Arbitration. District court did not err in finding Payich's
deceased mother had not signed a contract with the plaintiff nursing
home, and neither the mother's acceptance of benefits nor the terms of
the arbitration agreement proved a contract between plaintiff and Payich;
since there was no contract between plaintiff and Payich, there was no
contract of which the mother could be the third-party beneficiary, and her
estate was not bound by the arbitration agreement.
