U.S. Court of Appeals Case No: 12-3170
and No: 12-4032
U.S. District Court for the Western District of Missouri - Jefferson City
[PUBLISHED] [Melloy, Author, with Murphy and Shepherd, Circuit Judges]
Civil case - Insurance. The landlord's insurance policy unambiguously
precludes coverage of the wrongful death damages the landlord owes the
plaintiffs, and the district court erred in finding the plaintiffs were
entitled to collect $1 million in insurance proceeds from the insurer; it
was undisputed that the landlord owned the apartment building where
plaintiffs' decedents were killed as a business property and the policy in
question, a personal umbrella insurance policy, excluded the insured's
business properties.
