U.S. Court of Appeals Case No: 12-3339
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Loken, Author, with Colloton and Benton, Circuit Judges]
Criminal case - Sentencing Guidelines. In a prosecution charging defendant
with being a felon and unlawful drug user in possession of a firearm, the
district court did not err in imposing a four-level enhancement under
Guidelines Sec. 2K2.1(b)(6)(B) for possession of a firearm in connection
with another felony, as the district court clearly understood and properly
applied the "facilitate" standard of note 14(a); the Guideline does not
require that the weapon be loaded as an unloaded firearm retains the
potential to facilitate a drug crime.
