U.S. Court of Appeals Case No: 12-3491
U.S. District Court for the District of North Dakota - Bismarck
[PUBLISHED] [Smith, Author, with Wollman and Murphy, Circuit Judges] Criminal case - Criminal law. District court did not abuse its discretion by granting defendant's motion in limine to suppress an audio recording of a telephone call he made from jail in which he made an admission of guilt; while the admission of guilt contained on the tape was relevant, the probative value of the recorded conversation was outweighed by the danger of unfair prejudice, confusion of the issues and misleading of the jury, especially with respect to the issue of an affirmative defense under 18 U.S.C. Sec. 2243(c).
