U.S. Court of Appeals Case No: 12-3679
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Kelly, Author, with Gruender and Bright, Circuit Judges]
Civil case - Personal injury. Where the district court had ruled before
trial that an accident report was inadmissible, plaintiff's question to an
officer as to whether a box on the accident report was checked did not
justify defendant's subsequent questions concerning other elements of the
report, including the officer's opinions and conclusions from the report;
introduction of this evidence was improper, had a substantial influence on
the jury's verdict and requires reversal for a new trial.
