U.S. Court of Appeals Case No: 12-3701
Appeal from the Bankruptcy Appellate Panel for the Eighth Circuit
[PUBLISHED] [Bye, Author, with Chief Judge Riley and Gruender, Circuit
Judges]
Bankruptcy Case - sanctions. Bankruptcy court's finding that a portion of
debt Williams sought to collect in state court was pre-conversion debt was
not clearly erroneous. Bankruptcy court's grant of sanctions against
counsel for seeking to collect pre-conversion debt was not an abuse of
discretion and the court did not clearly err in refusing to allow
collection of post-conversion debt because Williams had failed to prove
amount of post-conversion debt. Bankruptcy court did not abuse its
discretion in denying second motion for relief.
