[PUBLISHED] [Bright, Author, with Bye and Smith, Circuit Judges] Civil case - Fair Housing Act. For the Court's prior opinion in the matter, see Smithrud v. City of Minneapolis, 456 Fed. Appx. 634 (8th Cir. 2012). By ordering the parties to brief the issue of whether plaintiff's complaints stated a claim under federal law, the district court was following this court's remand directions; the district court did not err in limiting its consideration of plaintiff's submitted evidence to those exhibits relevant to the issue; the district court did not err in concluding plaintiff's Fair Housing Act claims were time-barred by the Act's two-year statute of limitations; plaintiff's Section 1981 and 1983 claims were properly dismissed for failure to state a claim; the district court did not err by denying plaintiff's Rule 52(b) and 59(e) motions.
